A High Court judge previously said the only threat to Burke’s continued freedom would arise if he again breaches any existing order of the court.

Gardaí said they are aware of the matter, but that they have ‘no role at this time’.

The judge made the matter returnable to 11 January next.

In his ruling, Mr Justice O’Moore said ‘it was difficult to avoid the conclusion that Burke was exploiting his imprisonment for his own ends’.

Burke said that the offer to allow him to make submissions on why he should be released over Christmas was an ‘insult’.

Enoch Burke is set to remain in prison over the festive period as he refuses to obey a court order to stay away from the secondary school he taught at.

The teacher claims that an article published in the Sunday Independent in October regarding his alleged conduct in Mountjoy Prison contained untrue and defamatory statements.

Burke has been incarcerated since September for being in contempt of court.
