WE HAVE ALL been there before – you are going along to see your favourite American Football team have a scrimmage and take a seat on a marble bench to rest up on a sweltering day.
Jennelle Carrillo, of Cleburne, Texas, claims she did just that, only to get third-degree burns to her posterior.
The football fan has lodged a lawsuit against the Dallas Cowboys and their owner, Jerry Jones, alleging that the NFL franchise was liable for the burns she received to her buttocks.
According to CBS News, Carrillo received ‘severe burns to her backside’ after sitting on a black marble bench outside Cowboys Stadium in 2010.
The lawsuit, filed in Tarrant County civil court states:
The bench was uncovered and openly exposed to the extremely hot (100 degrees Fahrenheit) August sun.
“The combination of the nature of the black, marble bench and hot sunlight caused the bench to become extremely hot and unreasonably dangerous.”
Carrillo’s lawyer Michael Wash told CBS News that his client had to get skin grafts and was ‘hospitalised for up to a week’ following the procedure.
Wash also said Carrillo had ‘suffered mental anguish, physical pain and disfigurement as a result of her wounds’.
The Dallas Cowboys, according to the Huffington Post, have offered no comment due to the ongoing litigation, per team policy.
